New case grant (September 10, 2020).

This morning the Court granted leave in one new civil case. In Matter of Endara-Caicedo v. New York State Department of Motor Vehicles, the Court will consider whether Vehicle and Traffic Law § 1194(2) allows a motorist’s refusal to submit to a chemical test more than two hours after being arrested for driving under the influence to be used against the motorist in an administrative license-revocation proceeding.
