The Court issued motion decisions today and two days ago, granting leave in three new cases:
Dieffenbacher v. Jackson, 189 A.D.3d 710 (1st Dep’t 2020), a CPLR article 78 proceeding seeking prohibition to bar petitioner’s prosecution on double-jeopardy grounds.
Matter of Alvarez v. Annucci, 186 A.D.3d 704 (2d Dep’t 2020), about whether a prison facility was a legitimate residential treatment facility to house a sex offender.
Matter of Nonhuman Rights Project v. Breheny, 189 A.D.3d 583 (1st Dep’t 2020), about whether the writ of habeas corpus is available to a non-human animal.
