The Court granted leave in two new cases.
In Reis v. J.B. Kaufman Realty Co., the Court will consider whether a written lease-extension agreement, which did not set a definite amount of rent to be charged during the period of the extended lease, was an unenforceable “agreement to agree.”
In Batavia Townhouses, Ltd. v. Council of Churches Housing Development Fund Company, Inc., the Court will consider whether General Obligations Law § 17-105(1) or § 17-101 is the applicable provision to revive an otherwise expired statute of limitations on a mortgage loan.
The Court also recently accepted a case filed as of right. In Anderson v. Anderson, the Court will consider whether, for a nuptial agreement to be valid, the parties must reaffirm the agreement if it was not acknowledged by both parties when they signed it.
