The Court recently announced two new cases in which the Appellate Division granted leave to appeal to the Court of Appeals.
In Wells Fargo Bank NA v. Ferrato, the Court will consider whether a lender affirmatively revokes acceleration of a mortgage when it voluntarily discontinues a foreclosure action.
In Matter of Center on Privacy & Technology v. N.Y. Police Department, the Court will consider whether a court commits an unconstitutional prior restraint on speech when it bars a party from referring to the source of documents inadvertently disclosed in response to a Freedom of Information Law request.
