The big news over the past two weeks is the confirmation of Hon. Madeline Singas and Hon. Anthony Cannataro to fill the vacancies created by Judge Feinman’s and Judge Stein’s retirements. Included in the coverage were pieces from the New York Law Journal, predicting how Judge Singas will handle her new role; WhoWhatWhy, which says that Singas “has progressives fuming”; The National Herald, noting that Singas, which notes that Singas is the Court’s first Greek-American judge; and WSKG.com, observing that Singas “faced tough questions from senators on both the left and the right.”
At Bloomberg, Maeve Allsup covers the Court’s decision in Simmons v. Trans Express, which held that small claims judgment shave claim-preclusive, but not issue-preclusive, effect.
At Above the Law, Marla Decker explains, as part of a primer on litigation finance and state law, that the Court of Appeals will soon consider in Fast Trak Investment Company v. Sax whether some litigation-funding arrangements violate New York usury law.
Bennett Loudon, writing for the Western New York Daily Record, covers the Court’s decision in People v. Schneider, which held that “eavesdropping warrants are executed in the geographical jurisdiction where the communications are intentionally intercepted by authorized law enforcement officers.”
At Insurancenews.net, John Hilton reports that the New York Department of Financial Services has filed an appeal as of right to the Court of Appeals from a Third Department decision invalidating Regulation 187, which governs the sale of life insurance and annuities.
