The Court issued orders and motion decisions today and Tuesday, granting leave in one new civil case:
The Court granted leave in Dawson v. New York University, where it will consider whether a case challenging expulsion from a university is properly characterized as a CPLR article 78 proceeding and thus subject to a four-year limitations period.
The Court also dismissed as moot Matter of Gesmer v. Administrative Board of the New York State Unified Court System, the challenge to the State’s refusal to certificate for continued service Supreme Court justices who had reached the mandatory retirement age. The case became moot when the challengers were reinstated to the bench.
